Overview

Brazil's Law 14.478/2022 established a legal framework for virtual-asset service providers and designated the Banco Central do Brasil (BCB) as the authorising and supervisory body, while the securities regulator CVM oversees tokens that qualify as securities.

Regulatory framework

The BCB is finalising the authorisation regime for VASPs — covering exchange, transfer, custody and administration — following public consultations.

Licensing & authorisation

VASPs will require BCB authorisation once the implementing rules take effect; security-tokens fall under CVM rules.

AML & Travel Rule

AML obligations apply to VASPs; Travel Rule requirements are expected within the BCB's implementing framework.
