Overview

Australia currently requires digital-currency exchanges to register with AUSTRAC for AML purposes, while ASIC applies financial-services law where a crypto product is a financial product. The Treasury's Digital Asset Platforms reform would create a tailored Australian Financial Services Licence category for platforms holding customer assets.

Regulatory framework

Today: AUSTRAC registration + financial-services law where applicable. Coming: a bespoke AFS licensing category for digital-asset platforms.

Licensing & authorisation

Exchanges register with AUSTRAC; an AFSL applies where crypto is a financial product, with a dedicated regime proposed.

AML & Travel Rule

AUSTRAC applies AML/CFT obligations; a Travel Rule applies to digital-currency transfers.
